Notice is hereby given that the Murrieta City Council introduced Ordinance No. 588-23 at a Regular meeting on March 7, 2023 held at City Council Chambers, 1 Town Square, Murrieta, CA 92562. ORDINANCE NO. 588-23
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MURRIETA, CALIFORNIA, AMENDING CHAPTER 2.48.030 OF THE MURRIETA MUNICIPAL CODE REVISING THE REGULATIONS FOR TRAFFIC COMMISSION REGULAR MEETINGS AND FINDING OF EXEMPTION FROM CEQA
WHEREAS, on November 19, 1992 the City Council adopted Ordinance No. 26-92, establishing a Public Safety Commission and Ordinance No. 27-92, establishing a Transportation and Traffic Commission; and
WHEREAS, on June 17, 2003, the City Council adopted Ordinance No. 282-03, merging the Public Safety Commission and the Transportation and Traffic Commission into one Commission, identified as the Public Safety and Traffic Commission; and
WHEREAS, on July 7, 2009, the City Council adopted Ordinance No. 423-09, converting the Public Safety and Traffic Commission into the Traffic Commission as well as amending the duties and meeting schedule of the Commission; and
WHEREAS, the City of Murrieta “City” aims to achieve best governmental practices and ensure organizational efficiency; and
WHEREAS, currently the scheduled Traffic Commission meeting is set for the third Wednesday of every month at 6 PM; and
WHEREAS, based on the current schedule for meetings and input from the overseeing Department, Public Works/Engineering, there is a need to update the meeting requirements.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MURRIETA, CALIFORNIA DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Section 2.48.030 of the Murrieta Municipal Code is hereby replaced to read as follows (new language is indicated in bold and italics, language proposed to be deleted is shown with an underline and strikethrough:
“2.48.030 Regular meetings.
The traffic commission shall hold at least one regular meeting each month at such time, date and place designated by the traffic commission meet as needed at the time, date and place designated by the traffic commission.
SECTION 2. This ordinance is exempt from the California Environmental Quality Act (“CEQA”) under Section 15061(b)(3) of the CEQA Guidelines, which provides that CEQA only applies to projects that have the potential for causing a significant effect on the environment. Where, as here, it can be seen with certainty that there is no possibility that the activity in question would have a significant effect on the environment, the activity is not subject to CEQA.
SECTION 3. If any section, subsection, sentence, clause, or phrase of this ordinance is for any reason held to be invalid or unconstitutional by a decision of any court of any competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council hereby declares that it would have passed this ordinance, and each and every section, subsection, sentence, clause and phrase thereof not declared invalid or unconstitutional without regard to whether any portion of the ordinance would be subsequently declared invalid or unconstitutional.
SECTION 4. This Ordinance shall become effective on the thirty-first (31st) day after its passage and adoption, and within fifteen (15) days after its final passage and the City Clerk shall cause it to be posted and published in a newspaper of general circulation, printed, published and circulated in the City in the manner required by law and shall cause a copy of this Ordinance and its certification, to be entered in the Book of Ordinances of the City.
