CITY OF MURRIETA

ORDINANCE SUMMARY

 

Pursuant to Government Code section 36933(c), the following constitutes a summary of the ordinances introduced on February 15, 2022, and scheduled for further consideration and adoption at the April 5, 2022 Regular City Council meeting.

 

ORDINANCE 573-22

 AMENDING TITLE 10.44, OF THE MURRIETA MUNICIPAL CODE AND AUTHORIZING THE FILING OF THE ENVIRONMENTAL DETERMINATION

 

and

 

ORDINANCE 574-22

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MURRIETA, CALIFORNIA, AMENDING TITLE 16, OF THE MURRIETA MUNICIPAL CODE TO REVISE THE CITY'S DEVELOPMENT CODE, APPROVING DEVELOPMENT CODE AMENDMENT (DCA) 2021-2320 RELATED TO SECTIONS 16.08, 16.16, 16.20, 16.34, 16.44, 16.70, and 16.110 AND AUTHORIZING THE FILING OF THE ENVIRONMENTAL DETERMINATION

 

The City of Murrieta proposed amendments to Title 10.44.020 “Parking Prohibitions for Certain Vehicles”, which concerns the parking of vehicles on unimproved surfaces in residential areas with an exception of properties located within the Rural Residential (RR), Estate Residential (ER-1) and (ER-2) zones. Amendments were additionally provided for Title 16.08 for Single Family 2 (SF-2) and multi-family standards; Title 16.16 for master planned overlay and planned residential development general standards updates; Title 16.20 for Density Bonus information needed to be consistent with State law; 16.34 for parking requirements at density bonus sites in order to be consistent with State law; Title 16.44 for updates to residential accessory uses and structures for accessory dwelling units as well as moving container and storage container standards; Title 16.70 for updates to temporary use permits and types of permits with processing; Title 16.110 to update related definitions. On September 22, 2021, the Planning Commission conducted a public hearing and adopted PC Resolution No. 2021-09 (Limited to Title 16 Solely), recommending the City Council approve the proposed Development Code Amendment with a modification to Option B-1 for 16.44.150.K.1.a. “Cargo Containers As An Accessory Structure” in order to provide for one (1) additional cargo container for each additional five (5) acres with respect to a subject parcel.

 

The City Council conducted the first reading and approved for second reading the updates to Title 10.44.020, and the updates to Title 16, with the section of Option B-3. With the selection of Option-B-3, modifications were made for 16.44.150.K.1.k. “Cargo Containers As An Accessory Structure”, with implementation of an 18 month period to obtain conformance for existing structures from the effective of the Ordinance, and amendments to “Table 3-14 - Required Setbacks—Accessory Uses And Structures” that the minimum side setback of 10 feet be provide from the side property line for a “Cargo Containers As An Accessory Structure”.

 

The City held a public hearing on February 15, 2022, where Ordinances 573-22 and 574-22 amending the Murrieta Municipal Code were introduced with the following vote:

Ayes:       Stone, Warren, DeForest, Ingram

Noes:       White

Absent:    None
