PUBLIC NOTICE OF ORDINANCE ADOPTION
Notice is hereby given that the Murrieta City Council introduced the following Ordinance at a Regular meeting on February 15, 2022 during a public hearing held at a time certain of 6:15 p.m., at City Council Chambers, 1 Town Square, Murrieta, CA 92562. The City Council adopted the Ordinance at a Regular meeting on March 1, 2022, during a public hearing held at a time certain of 6:15 p.m., at City Council Chambers.

ORDINANCE NO. 572-22
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MURRIETA, CALIFORNIA, AMENDING SECTION 1.21.030 OF THE MURRIETA MUNICIPAL CODE AND ADOPTING REVISED DISTRICT VOTING BOUNDARIES
WHEREAS, On August 1, 2017, the City Council of Murrieta (“City”) adopted Ordinance No. 522-17 changing the City from an at large to a by-district voting system, adopting boundaries for the City’s five voting districts and establishing an implementation schedule for conversion to by-district voting during the 2018 and 2020 election cycles; and
WHEREAS, pursuant to Elections Code section 21601(a), the City is required to review its voting district boundaries following each decennial federal census; and
WHEREAS, in 2019, the Fair And Inclusive Redistricting for Municipalities And Political Subdivisions (“FAIR MAPS”) Act (AB 849) amended the process and criteria by which the City must evaluate and adjust its voting district boundaries; and
WHEREAS, as permitted under Elections Code section 21607.1(e), on September 25, 2021, a duly noticed public workshop conducted by City staff and the City’s redistricting consultant, Q2 Data and Research, was held for the purpose of explaining the redistricting process under the FAIR MAPS Act and receiving public input regarding communities of interest and the composition of one of more council districts; and
WHEREAS, at the regular City Council meeting of October 19, 2021, and at the special City Council meeting of October 28, 2021, the City Council held public hearings to receive public input regarding communities of interest and the composition of districts including at the latter meeting public live map drawing; and
WHEREAS, on October 29, 2021, accompanied by information on the total population, citizen voting age population, and racial and ethnic characteristics of the citizen voting age population of each council district depicted, a draft map (“Draft Map B”) was posted on the City’s redistricting website; and
WHEREAS, at the regular City Council meeting held on November 16, 2021, the City Council held a public hearing to receive public input regarding the composition of one or more council districts and, as described in this Ordinance, selection of Draft Map B to be the City Council District Map as that term is used in Murrieta Municipal Code section 1.21.030 A, which Ordinance was thereafter introduced for a first reading at the same regular meeting of the City Council; and
WHEREAS, at the regular City Council meeting held on December 7, 2021, the City Council held a public hearing to receive public input regarding the composition of one or more council districts and Draft Map B but did not adopt the Ordinance introduced on November 16, 2021; and
WHEREAS, at the special City Council meeting held on January 31, 2022, the City Council held a public hearing to receive additional public input and conduct a live map drawing session; and
WHEREAS, on February 1, 2022, the map attached hereto as Exhibit A accompanied by information on the total population, citizen voting age population, and racial and ethnic characteristics of the citizen voting age population of each council district depicted, was posted as a draft map (“Revised Draft Map B”) on the City’s redistricting website; and
WHEREAS, at the regular City Council meeting held on February 15, 2022, the City Council held a public hearing to receive public input regarding the composition of one or more council districts and, as described in this Ordinance, selection of Revised Draft Map B to be the City Council District Map as that term is used in Murrieta Municipal Code section 1.21.030 A, which Ordinance was thereafter introduced for a first reading at the same regular meeting of the City Council; and
WHEREAS, at the regular City Council meeting held on March 1, 2022, the City Council held a final public hearing to receive public input regarding the composition of one or more council districts and Draft Map B and to adopt Ordinance 572-22; and
WHEREAS, throughout the foregoing process, the City engaged in a significant amount of bilingual public outreach and engagement above and beyond the requirements of the FAIR MAPS Act including but not limited to community meetings, telephonic outreach, public announcement video, notifications by mail, newspaper noticing, social media and newspaper press releases, and public live map drawing.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MURRIETA DOES ORDAIN AS FOLLOWS:
SECTION 1. The above recitals are true and correct and incorporated herein by this reference.
SECTION 2. The map described in this Ordinance and attached hereto as Exhibit A is hereby adopted as the “City Council District Map” as codified in Section 1.21.030 A of the Murrieta Municipal Code and incorporated therein by this reference.
SECTION 3. If any section, subsection, sentence, clause, phrase, or portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining sections, subsections, sentences, clauses, phrase, or portions of this ordinance. The City Council hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase, or portion thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases, or portions be declared invalid or unconstitutional.
SECTION 4. This Ordinance shall be effective commencing on the thirtieth (30th) day after its adoption.
SECTION 5. The City Clerk shall certify to the adoption of this Ordinance and shall cause a copy of the same to be published in a manner prescribed by law.
