PUBLIC NOTICE OF ORDINANCE ADOPTION

Notice is hereby given that the Murrieta City Council introduced the following Ordinance at a Regular meeting on August 3, 2021 and adopted the Ordinance at a Regular meeting on September 21, 2021, commencing at 6:00 p.m., City Council Chambers, 1 Town Square, Murrieta, CA  92562.

ORDINANCE NO. 566-21

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MURRIETA, CALIFORNIA AMENDING CHAPTER 10.16 OF THE MURRIETA MUNICIPAL CODE REGARDING CHANGES TO SPEED LIMITS ON CERTAIN STREETS IN THE CITY OF MURRIETA PURSUANT TO STATE LAW

WHEREAS, the California Vehicle Code, including, but not limited to, sections 22357 and 22358, authorizes local authorities to increase or decrease local speed limits upon the basis of conducting an engineering and traffic survey; and

WHEREAS, State regulations require that local authorities review changes in local speed limits on a periodic basis to determine if the speed limits require updating; and

WHEREAS, the City currently regulates speed limits in the City of Murrieta pursuant to State law under Chapter 10.16 of the Murrieta Municipal Code; and

WHEREAS, the City has determined that thirty-one segments currently included in section 10.16.020 of the Murrieta Municipal Code require updating, maintaining the current speed limit for twenty-five of the segments; increasing the speed limit for five of the segments; and decreasing the speed limit for one segment; and

WHEREAS, four segments not previously included in section 10.16.020 require a new speed limit; and

WHEREAS, the desire to ensure the orderly movement of traffic in a reasonable and safe manner through appropriate speed limits requires the Council to take action.

NOW, THEREFORE, the City Council of the City of Murrieta, California, does ordain as follows:

SECTION 1.   That Section 10.16.020 of Chapter 10.16 of Title 10 of the City of Murrieta Municipal Code is hereby amended to read as follows:

10.16.020        Decrease of Local Limits

The prima facie speed limits declared in this section for each street or portion of a street designated shall be effective from and after the posting of appropriate signs giving notice thereof.  The names of the street upon which special prima facie speed limits are hereby declared, the portion of such streets affected by the declaration, and the declared prima facie speed limits therefore are as follows:

SECTION 2.  SIGNAGE.   The City Traffic Engineer is hereby authorized and directed to install the appropriate speed limit signage upon each street or road designated herein, giving notice of the prima facie speed limits established in this Ordinance. 

SECTION 3.  SEVERABILITY.   If any section, sentence, clause or phrase of this Ordinance is determined to be invalid, illegal or unconstitutional by a decision or order of any court or agency of competent jurisdiction, then such decision or order will not affect the validity and enforceability of the remaining portions of this Ordinance.  The City Council declares that it would have passed and adopted this Ordinance, and each section, sentence, clause or phrase thereof, regardless of the fact that any one or more sections, subsections, sentences, clauses, or phrases be declared invalid or unconstitutional.

SECTION 4.  EFFECTIVE DATE.  This ordinance shall take effect and be enforced thirty (30) days following its adoption.

SECTION .  NOTICE OF ADOPTION.  The City Clerk shall certify to the adoption of this ordinance and shall publish a summary of this ordinance and post a certified copy of the full ordinance in the office of the City Clerk at least five (5) days prior to the adoption of the proposed ordinance; and within fifteen (15) days after adoption of the ordinance, the City Clerk shall publish a summary of the ordinance with the names of the council members voting for and against the ordinance.

PASSED, APPROVED AND ADOPTED at a regular meeting of the City Council of the City of Murrieta, California, held on the 21^st day of September, 2021.
