CITY OF MURRIETA

NOTICE OF PUBLIC HEARING

 

NOTICE IS HEREBY GIVEN that a public hearing will be held before the City Council of the City of Murrieta on Tuesday, July 20, 2021 at 6:00 p.m. at City Hall, 1 Town Square, Murrieta, CA 92562, to consider the following matter:

 

MUNICPAL AND DEVELOPMENT CODE AMENDMENT (DCA 2020-2089) OF THE CITY COUNCIL OF THE CITY OF MURRIETA, CALIFORNIA, REGULATING MASSAGE BUSINESSES AND MASSAGE THERAPIST: A request to the City Council to introduce and place on first reading an ordinance which will repeal Chapter 5.18, entitled “Massage Establishments” in its entirety, and add Chapter 5.18, entitled “Massage Businesses and Massage Therapists” to the Murrieta Municipal Code, and amend Sections 16.08, 16.10, 16.11, 16.12, 16.13, 16.14, 16.34, 16.44, and 16.110 of the Murrieta Development Code regulating massage businesses and massage therapist.

 

Environmental Determination:   The proposed code amendment has been evaluated pursuant to the California Environmental Quality Act (CEQA) and it has been determined that the Code amendments will have no significant adverse impacts on the environment. Any future growth will be limited with respect to the distance and population caps per location for stand-alone establishments and massage accessory uses would be inclusive of locations that have an operational component related to existing business operations. In addition, it is reasonably to conclude that a portion of the existing stand-alone establishments may discontinue operations over time, as some locations will no longer be eligible for replacement operations due to discontinuation by operators and replacement locations would be required to adhere to zoning distance buffers and population cap criteria as provided within the Ordinance. From an intensity perspective, these locations would result in similar occupancy levels and the number of vehicle trips as other personal service uses. Lastly, it concerns general policy and procedure making under enforcement framework. Provided this background, the City finds that the proposed amendments to the City’s Municipal Code under this Ordinance are exempt from environmental review pursuant to the “Common Sense” exemption, Section 15061(b)(3) of the California Environmental Quality Act (CEQA) Guidelines, since there would not result in a significant effect on the environment.

 

Any person may either submit written comments to the City Council before the hearing or may appear and be heard before the City Council at the time of the hearing.  If you challenge the City’s action on this project in court you may be limited to raising only those issues you or someone else raised at the public hearing described in this notice, or in written correspondence delivered to the City Council at, or prior to the public hearing.  The environmental finding along with the proposed project application may be reviewed at the Planning Division counter Monday – Thursday from 8:00 a.m. - 5:00 p.m. and every other Friday from 8:30 a.m. – 4:30 p.m.

 

It is the intention of the City to comply with the Americans with Disabilities Act (ADA) in all respects.  Upon request, this Agenda will be made available in appropriate alternative formats to persons with disabilities.  If you require modification, accommodation or special assistance to attend or participate in this meeting, please contact the City Clerk Department at (951) 461-4030 at least 48 hours prior to the meeting date.  The 48-hour notification period will enable the City to make reasonable arrangements to ensure accessibility to this meeting.
