[ARCHIVED] Public Hearing-Development Code Amendment (DCA2019-1878) Short-Term Vacation Rentals





NOTICE IS HEREBY GIVEN that a public hearing will be held before the City Council of the City of Murrieta at a Special City Council Meeting on Monday, October 12, at 2:00 PM AS A TELECONFERENCE MEETING based at City Hall, 1 Town Square, Murrieta CA 92562, to consider the following matter:  


DEVELOPMENT CODE AMENDMENT (DCA-2019-1878) “SHORT-TERM VACATION RENTALS”:   A request by the City of Murrieta to amend sections 16.08, 16.10, 16.11, 16.12, 16.14, 16.34, 16.38, 16.44, 16.110 of the City’s Municipal Code, which primarily concern the locational aspects of short-term vacation rentals with different options, sign and parking regulations. Furthermore, Title 5.27 of the Municipal Code is proposed to be considered, which covers the operational aspects relating to Short-Term Vacation Rentals. 


Environmental Determination:  The proposed code amendment has been evaluated pursuant to the California Environmental Quality Act (CEQA) and is not a “project” subject to the in accordance with State CEQA Guidelines Sections 15060 (c)(2), 15060 (c)(3), 15378(a), and 15301 of the State CEQA Guidelines. Pursuant to Title 14 of the California Code of Regulations, Section 15378, staff has determined that the proposed Short-Term Vacation Rental Ordinance is exempt from the requirements of the California Environmental Quality Act (CEQA) in that it is not a “project” as defined by the Act, in that it does not have a potential for resulting in a physical change in the environment, directly or ultimately as compared to the current baseline. These are currently operating throughout the City under an unregulated framework within existing residences. It involves operation, permitting, renting and/or licensing of existing private structures or facilities involving negligible or no expansion of existing or former use. The use under this amendment is framed in a similar manner as a longer-term residential use in terms of a physical presence with occupancy and access. Additionally, it concerns general policy and procedure making under enforcement framework.


Any person may either submit written comments to the City Council before the hearing or may appear and be heard before the City Council at the time of the hearing via TELECONFERENCE.  State law provides that if you challenge the City’s action on this project in court you may be limited to raising only those issues you or someone else raised at the public hearing described in this notice, or in written correspondence delivered to the City Council via EMAIL OR TELECONFERENCE prior to the public hearing.
