Subject :Convicted Felon In Possession of an Assault Rifle

On Monday – October 8th, 2012, at approximately 2135 hours, a Murrieta police officer was on routine patrol, near the intersection of Los Alamos Rd. and Monroe Ave., and conducted a traffic stop on a vehicle in regards to a vehicle code violation.

During the officers’ traffic stop, he smelled an overwhelmingly strong odor of marijuana emanating from inside the vehicle.  The front passenger admitted to having marijuana in the vehicle and handed the officer a green pill bottle containing marijuana.  This subject was identified as Edward Michael Hernandez (24-year-old resident of Menifee). 

Further investigation led the officer to locate and recover two rifles inside the vehicle, one of which was an AK-47 type assault rifle.  The serial number to the assault rifle had been filed off and was illegible.  Investigative questioning by the officer revealed Mr. Hernandez was responsible for the weapons.  A criminal history records check on Mr. Hernandez revealed he has a prior felony conviction, which would be an additional violation to be in possession of said weapon(s).

Based on the totality of the circumstances, Mr. Hernandez was placed under arrest per 29800(a)(1)PC – Convicted felon in possession of a firearm, 30605(a)PC – Possession of an assault rifle, 23900PC – Alter or remove a serial number on a rifle; as well as two misdemeanor active warrants for his arrest.  Mr. Hernandez was transported to the Southwest Detention Facility to complete the booking process.
